Title: A proposal for setting a standard of care in international law for cross-border Internet

Concise Description:
According to the Tunis Agenda, "[p]olicy authority for Internet-related public policy issues is the sovereign right of States. They have rights and responsibilities for international Internet-related public policy issues".

In addition, the Tunis Agenda recognised "the need for enhanced cooperation in the future, to enable governments, on an equal footing, to carry out their roles and responsibilities, in international public policy issues pertaining to the Internet [...]".

International law provides guidance and examples on primary obligations of states to co-operate in developing common responses for activities which may cause transboundary harm.

A group of experts of the Council of Europe has developed a conceptual framework for international co-operation in respect of the protection of critical Internet resources and the protection of cross-border flow of Internet traffic.

It includes due diligence commitments to co-operate in the prevention of, preparation for and provision of responses to activities which may have adverse effects to the stability and security of the Internet. Such commitments should also extend to building adequate protections for human rights and fundamental freedoms and the public interest in processes and decisions taken in connection with the management of critical Internet resources.

The goal of this workshop is to gather and exchange views with stakeholders on concrete international co-operation responses that may be developed in this context.
